Miami Beach Embraces Medical Marijuana Accommodations for City Employees

In a landmark decision reflecting evolving attitudes toward medical cannabis, the City of Miami Beach has announced it will accommodate employees who are prescribed medical marijuana. This policy shift positions Miami Beach among the first municipalities in Florida to formally recognize the rights of medical marijuana patients within its workforce.​

The decision, made by city commissioners last week, ensures that city employees holding valid medical marijuana prescriptions will receive appropriate workplace accommodations. The policy change comes on the heels of a significant legal development in Florida. In February 2025, a Florida state court ruled in Giambrone v. Hillsborough County that public employers must accommodate off-duty, off-site medical marijuana use for qualified patients. The court found that failing to do so could constitute a violation of the Florida Civil Rights Act, which prohibits discrimination based on disability.

This ruling has prompted municipalities across the state to reevaluate their employment policies concerning medical marijuana. Miami Beach’s proactive approach demonstrates a commitment to inclusivity and the well-being of its employees.​
