The policy change comes on the heels of a significant legal development in Florida. In February 2025, a Florida state court ruled in Giambrone v. Hillsborough County that public employers must accommodate off-duty, off-site medical marijuana use for qualified patients. The court found that failing to do so could constitute a violation of the Florida Civil Rights Act, which prohibits discrimination based on disability.
